Doc suspected in Omaha killings due in Ill. court

JONESBORO, Ill. (AP) ? A doctor suspected in four slayings in Nebraska is scheduled for another southern Illinois court appearance that could decide how quickly he'll return to Omaha to face murder charges.

Anthony Garcia, of Terre Haute, Ind., is set for a court hearing Wednesday morning in Union County, where he was arrested Monday during a traffic stop.

Garcia's brief court appearance Tuesday in Jonesboro, Ill., was deferred so he could consult with an attorney.

The 40-year-old doctor is being held without bond on suspicion of involvement in the killings of three adults and an 11-year-old boy in Nebraska. All four victims had ties to an Omaha university medical school from which Garcia was fired in 2001.

Authorities say that when arrested, Garcia appeared to be intoxicated and had a .45-caliber handgun.

US and Cuba discuss migration issues

WASHINGTON (AP) ? Migration issues headlined talks on Wednesday between the U.S. and Cuba, yet long-standing disputes threaten efforts to thaw relations between the Cold War enemies.

In the one-day talks, Cuba repeated its opposition to the United States' so-called wet-foot, dry-foot policy in which Cuban refugees reaching American soil are allowed to stay while those stopped at sea are sent home. Cuba says the policy urges its citizens to try to flee the island.

"Alien smuggling could not be eradicated nor a legal, safe and orderly migration between the two countries could be achieved as long as the wet-foot, dry-foot policy and the Cuban Adjustment Act, which encourage illegal migration and irregular entries of Cuban citizens into the United States, remain in force," the delegation said in a statement. The act lets islanders who reach the United States stay and fast-tracks them for residency.

American officials reiterated their call for the immediate release of a US Agency for International Development worker, Alan Gross, imprisoned in Cuba since Dec. 3, 2009. Gross was working on a USAID democracy-building program when he was arrested. Washington has said repeatedly that no major improvement in relations can occur until he is released.

The migration talks were announced last month after Havana and Washington wrapped up separate negotiations aimed at restarting direct mail service, which has been suspended since 1963. Discussions about migration and mail ? along with the relaxation of travel and remittance rules for Cuban Americans ? appeared to signal a thaw in chilly relations.

But two recent events ? Cuba's backing of National Security Agency leaker Edward Snowden's bid for asylum and the interception of weapons hidden on a ship that had sailed out of Cuba bound for North Korea ? now pose new setbacks to warming relations.

Earlier this month, Cuban President Raul Castro threw his support behind other Latin American governments willing to give asylum to Snowden, who has since sought temporary asylum in Russia. Castro made no reference as to whether Cuba itself would offer him refuge or safe passage. Snowden's simplest route to Latin America might be one of five direct flights that Russian carrier Aeroflot operates to Havana each week. From there Snowden could fly to Venezuela, Bolivia or Nicaragua, all possible destinations for him.

On Tuesday Panamanian authorities seized a 14,000-ton ship with a cargo of missiles and other arms hidden under sacks of sugar. Cuba claimed the military equipment was obsolete weaponry from the mid-20th century that it was sending to North Korea for repair. The incident underscored concerns about Cuba's relationship with North Korea, which is in a standoff with the U.S. and its allies for continuing to develop nuclear weapons.

Cuba's delegation to the migration talks said the discussion took place in a "climate of respect" and said it was willing to hold more exchanges in the future. The delegation said Cuba used the meeting to announce that the government of Cuba had ratified international protocols on migrant smuggling and human trafficking.

Marie Harf, deputy spokeswoman at the State Department, said the discussion focused on the implementation of the 1994 and 1995 U.S.-Cuba migration accords. The talks are intended to monitor adherence to a 16-year-old agreement under which the U.S. issues 20,000 visas to Cubans each year. Wednesday marked the first time since January 2011 that the periodic talks have been held.

"The U.S. delegation highlighted areas of successful cooperation in migration, including advances in aviation safety and visa processing, while also identifying actions needed to ensure that the goals of the accords are fully met, especially those having to do with safeguarding the lives of intending immigrants," Harf said.

Cuba, however, remains on the U.S. list of state sponsors of terrorism, another sticking point in the migration talks. Havana denies any links to terrorism and contends its inclusion on the list is a political vendetta.

Sen. Robert Menendez, chairman of the Senate Foreign Relations Committee, called the shipment of weapons a "grave violation" of international treaties and called on the Obama administration to submit the case to the U.N. Security Council for review.

Rep. Ileana Ros-Lehtinen, a Republican from Florida who is staunchly opposed to the Raul Castro government, urged the State Department to call for U.N. Sanctions Committee inspectors to go to Panama and investigate whether North Korea and Cuba have violated U.N. resolutions.

Planned China nuclear plant axed after protest: report

Plans for a nuclear processing plant in southern China have been cancelled, media reported Saturday, following the latest in a series of protests that reveal growing environmental concerns in the country.

Almost 1,000 people on Friday walked through the centre of Guangdong province's Jiangmen City, which is 30 kilometres (20 miles) away from the proposed facility at Longwan Industrial Park, the local Jiangmen Daily said.

The demonstration, which was billed as an innocent stroll, was organised online in opposition to the fuel processing plant, which some domestic reports say could have provided enough fuel for about half of China's atomic energy needs -- or 1,000 tonnes of uranium -- by 2020.

The 37 billion yuan ($6 billion) project, which features uranium conversion and enrichment facilities, was cancelled on Saturday, state-run news agency Xinhua said, citing local officials. The project was the first nuclear fuel production plant planned for southeast China, china.org.cn said, a website under the information department of the State Council.

"We don't need such projects to boost the economy," a resident surnamed Liu, who was attending the protest, was quoted by the website as saying. Demonstrations over environmental issues have increased in China, where three decades of rapid and unfettered industrial expansion have taken their toll.

Similar incidents are reported regularly around the country, many over projects that people say are linked to corruption, but authorities typically quash the protests and push ahead with their plans.

Local authorities in the coastal city of Xiamen cancelled plans for a chemical plant after thousands took part in a protest in 2007. A huge protest in the northeastern city of Dalian in 2011 prompted authorities to announce a similar climbdown.

Star Wars Angry Birds 2 launching September 19th with Skylandersesque toy tiein

In a wholly unsurprising move, Finnish game dev studio Rovio Entertainment is creating yet another entry in its prolific Angry Birds series -- Angry Birds Star Wars 2. As its name implies, ABSW2 is the sequel to the first Star Wars-themed Angry Birds entry, which launched on various mobile devices last November. Its sequel will arrive on September 19th, and apparently features "over 30 playable characters." There aren't set launch platforms just yet, but we're guessing "iOS and Android devices" is a pretty safe bet; Windows Phone 8 as well, perhaps.

What is surprising is that the newest Angry Birds entry has a physical twist that we've yet to see from the brand: something called "telepods." The Hasbro-created toy is a physical representation of an in-game character, and Rovio Entertainment's VP of marketing Philip Hickey tells us it works by using a mobile phone or tablet's built-in camera to read the toy and implement it in-game -- an interesting choice in a world where Activision's NFC-based Skylanders rules the toy-based game landscape. As such, the toys likely won't function on game consoles, making it likely that any non-mobile version of the game will require some custom work to adapt. Hickey also tells Engadget that the toys will be available at retail alongside the game's September 19th launch, and that Rovio's exploring the possibility of making them function with previous series entries.

Markets shored up by China's 7.5 percent growth

LONDON (AP) ? Relief over China's economic growth rate helped shore up the mood in financial markets Monday despite weaker than anticipated U.S. retail sales figures.

China, the world's second-largest economy grew 7.5 percent from a year earlier in the second quarter. Though the figure is down on the previous quarter's 7.7 percent, there had been fears that it may have fallen below 7 percent in the wake of efforts by the country's monetary authorities to clamp down on risky lending. A sharp drop would hurt companies around the world that have become increasingly reliant on breakneck Chinese growth to boost earnings.

"China's growth rate might still be on a steadily declining path, but investors were happy enough to see it come in line with expectations, growing by 7.5 percent in the second quarter," said Chris Beauchamp, market analyst at IG. "Beijing was keen to emphasize that internal consumption was picking up the slack, and helpfully retail sales rose strongly during June."

Combined with an easing in tensions over Europe's financial crisis and diminishing fears about the Federal Reserve's plans to rein in its monetary stimulus, the figures bode well for markets.

"We could be in for a week of quiet, steady gains for stock markets," he said.

Following a 1 percent rise in the Shanghai Composite Index to 2,059.39, European stock markets posted solid gains. The FTSE 100 index of leading British shares was up 0.5 percent at 6,576, while Germany's DAX rose 0.3 percent to 8,237. The CAC-40 in France was 0.6 percent higher at 3,877.

In the U.S., the Dow Jones industrial average was up 0.1 percent at 15,480, while the broader S&P 500 was steady at 1,680.

The opening on Wall Street was not as strong as futures markets had been predicting. That was a result of the news that U.S. retail sales only grew 0.4 percent in June from the month before. That was half the rate expected and may mean downward revisions to U.S. second quarter growth forecasts. Retail sales account for around 70 percent of U.S. economic activity.

"After today's report, there is a very real possibility that Q2 GDP will be less than 1 percent for the second time in the last three quarters," said Dan Greenhaus, chief global strategist at BTIG.

Though the figures suggest the U.S. economy is not growing as quickly as anticipated, they may mean the U.S. Federal Reserve starts reducing its monetary stimulus later. For weeks the Fed's monetary stance has been the main driver in markets. The Dow and the S&P 500 struck all-time highs last week partly on an indication from the Fed that the monetary stimulus may be in place for longer than previously expected. At the moment, the Fed is buying around $85 billion of assets in the markets, and that's helped prop up stocks for months.

Some comfort came from forecast-busting earnings from Citigroup. The bank made $1.25 per share during the second quarter, beating the $1.18 per share predicted by analysts polled by FactSet.

It's a busy week on the U.S. corporate reporting front. Other reports expected this week include Coca-Cola, Goldman Sachs, Johnson & Johnson, Bank of America, Google and Microsoft. General Electric caps off the week Friday.

The dollar has faltered in recent days as expectations of a Fed tightening have eased. It clawed back some ground Monday, with the euro 0.2 percent lower at $1.3044. The dollar was 0.7 percent higher at 100.09 yen.

Earlier in Asia, Hong Kong's Hang Seng added 0.1 percent to 21,303.31 and Sydney's S&P/ASX 200 gained 0.1 percent to 4,981.10. South Korea's Kospi rose 0.3 percent 1,875.16. Japan's financial markets were closed for a public holiday.

Oil prices gave up some recent gains. Benchmark crude for August delivery was down 97 cents at $104.98 a barrel in electronic trading on the New York Mercantile Exchange. The contract gained $1.04 to $105.95 in New York on Friday, driven higher by continuing tensions in Egypt and a sharp drop in U.S. crude stockpiles.

Canada's Loblaw to buy Shoppers Drug Mart for $12 billion

REUTERS - Loblaw Cos Ltd (L.TO), Canada's largest food retailer, will buy Shoppers Drug Mart Corp (SC.TO), the country's biggest pharmacy chain, for C$12.4 billion to bulk up against intensifying competition from U.S. retail giants as well as from consolidating local rivals.

News of the tie-up, Canada's biggest merger and acquisition deal so far this year, sent Shoppers shares soaring 26 percent and Loblaw shares up 8 percent on the Toronto Stock Exchange on Monday.

By acquiring Shoppers, Loblaw said it will create a combined retail operation with more than C$42 billion in annual revenue. The move also gives it a foothold in the growing small urban store sector.

The deal is more than double the size of the one that rival grocer Empire Co Ltd (EMPa.TO) announced a month ago, when it said it was acquiring Safeway Inc's Canadian assets for $5.7 billion. That deal cemented Empire's position as Canada's No. 2 grocer after Loblaw.

The consolidation has been spurred by competition from big U.S. retailers such as Target Corp (TGT.N) and Wal-Mart Stores Inc (WMT.N), which have been ramping up expansion in Canada and looking for ways to reach more customers in tighter urban locations. Target opened its first 24 Canadian stores in March and plans to have 124 stores across the country by yearend.

"We think the deal was a long time coming. We think no one should be surprised, Shoppers Drug Mart was a sitting duck," said Barry Schwartz, a portfolio manager at Baskin Financial Services, which owns some 140,000 shares of Shoppers. "I think the Empire-Safeway transaction lit a fire under a Loblaws to make a deal."

REGULATORS WILL SCRUTINIZE

The agreement could face regulatory challenges, however, even though the companies called its timing "optimal" from a regulatory standpoint.

Canada's Competition Bureau said in a statement it will review the proposal, but could not specify how long it will take. The companies said the deal is expected to close within six or seven months.

Executives said the businesses do not substantially overlap and that they do not foresee any substantial sales of existing assets to meet regulatory requirements. The two companies noted the transaction would not significantly change market share in their respective food and pharmacy businesses.

"We believe the Canadian retail space is as competitive - if not more so - than any place in the world," Galen Weston, executive chairman of Loblaw, told reporters.

"You've got ... the most compelling and aggressive international retailers in mass merchandising space in Canada, growing this year at a rate that is faster than at any time in Canadian history. So the starting point is a very competitive market."

Loblaw's offer of C$61.54 in cash and stock represents a premium of 27 percent to Shoppers Drug Mart's Friday closing price on the Toronto Stock Exchange. The companies said there are no plans to close any Shoppers Drug Mart stores.

COST SAVINGS SEEN

Shoppers Drug Mart, which turned 50 last year, owns about 1,300 drug stores and 65 Shoppers Home Health Care stores across Canada. Like Target and Wal-Mart, the company also sells beauty products.

The company changed hands a number of times until it went public in 2001. Previous owners have included Imasco, a unit of Imperial Tobacco, and a consortium of private-equity firms including KKR and Bain Capital.

Shareholders of Shoppers Drug Mart will have the option to either receive C$61.54 in cash or 1.29417 Loblaw common shares plus 1 Canadian cent in cash for each share held. The maximum amount of cash to be paid by Loblaw will be about C$6.7 billion.

Shoppers Drug Mart shareholders will own about 29 percent of the combined company. Shoppers Drug Mart will retain its name and brand and will operate as a separate division of Loblaw.

The combination is expected to yield annual cost savings of C$300 million by the third year, Loblaw said.

George Weston Ltd (WN.TO), Loblaw's biggest shareholder, will buy an additional C$500 million in Loblaw shares to help finance a the deal. George Weston now owns about 62 percent of Loblaw.

Loblaw said it would finance the cash portion of the deal with cash on hand and committed bank loans.

BofA Merrill Lynch acted as financial adviser to Loblaw, while Torys LLP was its legal counsel.

RBC Capital Markets advised Shoppers Drug Mart on the deal. Osler, Hoskin & Harcourt LLP was its legal counsel.

Loblaw shares have climbed 47 percent in the past year, while Shoppers shares have risen 17 percent.

Keepin' it real fake HTC One finally gets a convincing plastic clone

We hate to say this, but the KIRF market is often a good indicator of how popular certain devices are, hence the plentiful fake iPhones and Galaxy phones in China. (Meanwhile, MediaTek is shamelessly cashing in as it ships its SoCs to those cloning factories.) Now, we're not saying the HTC One doesn't have any clones, but most of those we've seen weren't very convincing -- they were either of different sizes or had very poor build quality. But we eventually stumbled upon a pretty good fake in Huaqiangbei.

The offending device is pictured above on the left. Externally, it bears a disgustingly strong resemblance to the real deal thanks to the same 4.7-inch screen size, the same curved back, the same micro-SIM tray, the same dual-soft-key layout and even the same metallic chamfer on the front. But if you look closer or touch it even, the tell-tale signs start to show up. See for yourself in the gallery below -- the fake One is to the left or on top of the real thing.

Northern Mich. University Tuition Up 3.75 Percent

MARQUETTE, Mich. (AP) - Northern Michigan University's trustees have boosted tuition and fees by 3.75 percent for the 2013-14 academic year.

The board approved the increase Friday. The annual cost for full-time resident undergraduates will be $9,094. That's up $328 from last year's rate of $8,766.

Vice President for Finance Gavin Leach says the university in Marquette also will increase financial aid by 6.6 percent, which will offset about one-third of the bump.

Northern Michigan says it remains within the tuition restraint level required to secure its full 2.1 percent state appropriation increase under a higher education bill approved by the Legislature in June.

Trustee Steven Mitchell says he regrets the higher rate and acknowledges it will be a hardship for some students. But he adds they're getting a good return on their investment.
