New Google data show Microsoft's piracy problems

SAN FRANCISCO (AP) -- Google's Internet search engine receives more complaints about websites believed to be infringing on Microsoft's copyrights than it does about material produced by entertainment companies pushing for tougher online piracy laws.

A snapshot of Microsoft's apparently chronic copyright headaches emerged in new data that Google released Thursday to provide a better understanding of the intellectual property abuses on the Internet.

Google has a good vantage point on the issue because it operates the Internet's dominant search engine with the largest index of websites. About 97 percent of the copyright removal requests sent to Google are found to be valid by the company, prompting the offending links to be blocked from its influential search results.

The new report includes a breakdown of all requests Google has received since July 2011 to remove copyright-infringing content from its search index. Google plans to update the information daily at http://www.google.com/transparencyreport/removals/copyright .

Google Inc. has logged more than 2.5 million requests in the past 11 months to remove links believed to be violating Microsoft's copyrights. That ranked well above second-place NBC Universal, the operator of several television networks and a movie studio, whose copyrighted content was cited in nearly 1 million removal requests during the same period.

The data doesn't identify the specifics of the reported infringements, but Microsoft Corp. confirmed virtually all of its complaints are about websites offering bogus versions of its Windows operating system and other software.

"Each month, Microsoft requests the removal of links to web pages that infringe Microsoft's copyrights so that customers are not deceived into purchasing or downloading counterfeit software," company spokesman Lou Gellos wrote in an email.

Copyright-protected content owned by major music labels also spurred a high volume of removal requests.

The Recording Industry Association of America, which has railed against digital piracy since the rise and fall of Napster's music-sharing service more than a decade ago, was identified as the copyright owner in more than 416,000 requests. Other copyright owners on Google's Top 10 list of removal requests include Universal Music and Sony Music and an adult entertainment site, BangBros.com.

Google decided to share its insights on copyright abuse amid a rising outcry for a crackdown against online piracy that media companies have claimed is collectively costing them billions of dollars each year. The backlash inspired a piece of get-tougher legislation dubbed the Stop Online Piracy Act, or SOPA, that had the backing of most major music and move studios. The proposal caused dismay among major Internet companies who feared the law would stifle free speech and innovation. The bill was abandoned four months ago after fierce high-tech opposition that included a one-day blackout of popular websites such as Wikipedia and an online petition drive spearheaded by Google.

Microsoft also opposed SOPA, although it wasn't as strident in its criticism as other major technology companies. The Business Software Alliance, a group that includes Microsoft, initially supported SOPA before reversing its position as the backlash to the proposal intensified.

Online infringements in the U.S. are currently covered by the Digital Millennium Copyright Act, which requires the content owner to police sites for violations and then send requests to take down the material. Websites are required to respond promptly.

Google says it now responds to requests within 11 hours, despite a rising volume of complaints. It sometimes receives more than 250,000 removal requests in a week, exceeding the total number sent to the company during the entire year of 2009. In the past month alone, Google received 1.2 million removal requests on behalf of 1,000 copyright owners who believe their content was being infringed upon at nearly 23,000 different websites, according to a blog post Thursday by Fred von Lohmann, the company's senior copyright lawyer.

In an interview Thursday, von Lohmann attributed the increased number of complaints to more sophisticated tracking technology that has enabled copyright owners to pinpoint violations more quickly than in the past.

The websites most frequently targeted in the copyright complaints sent to Google were filestube.com (nearly 390,000 links requested for removal), torrentz.eu (more than 147,000 links) and 4shared.com (more than 132,000 links).

Google's new report doesn't include copyright removal requests sent to its popular video site, YouTube, or its Blogger service. But Google's search engine receives the most copyright complaints, accounting for about 60 percent of the 5.4 million removal requests the company processed last year, von Lohmann said.

Update: Elton John's publicist confirms to TODAY.com that John has been released from?the hospital. No other details about John were released.

Original story: Singer Elton John was hospitalized for a serious respiratory infection Wednesday and will have to cancel several tour dates, TMZ is reporting.

According to the site, John checked into Cedars-Sinai hospital in L.A., and his doctors recommended that he not perform for seven days, citing the need for "complete rest and antibiotic treatment to prevent damage."

Four concerts scheduled for this weekend in Las Vegas were canceled, but they will be rescheduled.

"It feels strange not to be able to perform these 'Million Dollar Piano' concerts at the Colosseum (at Caesars Palace)," John told TMZ. "I love performing the show and I will be thrilled when we return to the Colosseum in October to complete the 11 concerts."

(AP) ? With another season on the brink, Dwyane Wade and LeBron James took their two-man game to new heights.

Just like that, the Miami Heat and a Big Three-Minus-One are headed back to the Eastern Conference finals.

Wade scored 41 points, James added 28 and the Heat finished off the once-frisky Indiana Pacers 105-93 in Game 6 Thursday night, advancing to face either Boston or Philadelphia in the next round.

The way Miami's dynamic duo is playing, it may not matter who's got next.

"They're going to be tough to beat by anybody," Indiana coach Frank Vogel said.

This was a 4-2 triumph that came down to a trilogy, Wade and James responding with the most remarkable week of their high-powered partnership, just when it looked as though the Heat were down and might be out.

Over the course of three dazzling games, James scored 98 points, grabbed 34 rebounds and dished out 24 assists. Wade had 99 points, 22 rebounds and 11 assists. Chris Bosh, sidelined by an abdominal injury, wasn't missed at all.

"In the regular season, we've had some good games," Wade said. "But I don't know if we've ever had three in a row like that in the playoffs, the way we played off each other."

Of course, nothing less than an NBA title will do in South Beach.

Two series down, two to go.

One week earlier, Miami was down 2-1 after getting thumped 94-75 in Indianapolis. The fired-up Pacers had another game on their home court and a chance to build a commanding lead.

Wade and James simply refused to let it happen.

"We understand that when Chris went out, we had to step up," D-Wade said. "The team looked to us to lead."

The banged-up Heat will get a chance to relax a couple of days before worrying about the next opponent, who will be determined in Game 7 at Boston on Saturday. The conference finals start Monday in Miami.

Bosh hopes to return at some point, but it might not matter.

Not the way Wade and James are playing.

"Chris Bosh is an awesome basketball player, but when he goes down, that just means more touches for LeBron and Wade," Vogel said. "That's not exactly an advantage."

The Heat rallied from an early 11-point deficit, riding the hot hand of Wade in the opening half. He scored 26 points by the break, tying Tim Hardaway's 16-year-old franchise record for most playoff points in the first two quarters. James hit consecutive baskets with just over a minute remaining to close it out.

David West led Indiana with 24 points and all five starters were in double figures. Balance, it turned out, was no match for Wade and James.

"Guys are disappointed but understand that it's not our time yet," West said.

In a game of spurts, the decisive one came in the closing minutes of the third quarter.

The Pacers tied it at 66 on Darren Collison's 3-pointer, but it was all Heat the rest of the period. They closed on a 13-3 run, capped by Mario Chalmers' buzzer-beating 3 from the corner. Wade, who was on the bench getting his customary breather at the end of the quarter, leaped from his seat as the ball left Chalmers' hand at the far end, raced along the baseline and pumped his fist when it swished.

When Chalmers raced toward the Miami bench, Wade greeted him near the free throw line with a low-five.

"We just had a bad stretch," West said. "They got us in the third quarter."

Cheerleading aside, D-Wade did his best work while in the game. He dropped 11-of-16 shooting on the Pacers in the first half, but also made sure the MVP stayed involved, dishing off a behind-the-back pass to James for a thunderous jam.

"They're too good," West said. "They pressure you all over the place."

There was none of the nastiness that marked Game 5, when a bunch of flagrant fouls resulted in suspensions for two Miami players, co-captain Udonis Haslem and backup center Dexter Pittman. Pacers president Larry Bird was so disgusted with his team's performance in a 95-86 loss that he accused them of going "soft."

Toughness wasn't the problem this time. This was merely a Miami team on a mission, a mission that began in the summer of 2010 when the Heat signed James and Bosh to join Wade in a seemingly unbeatable trio. There was a glitzy introduction and predictions of multiple championships, which left the rest of the league seething and plenty of people cheering when Miami was knocked off in the NBA finals by the Dallas Mavericks last season.

Shaking off that disappointment, James had perhaps his greatest season yet. But it was Wade who took control in the decisive game against the Pacers. He sliced into the lane, throwing up a one-handed shot that looked like it might go over the backboard, only to catch the top of the glass and drop through, barely touching the twine. He delivered one final blow when he split West and George Hill, banking in the shot despite taking a knee from Hill that sent the Heat guard tumbling to the court.

"We just didn't have enough yet," Vogel said, "but we'll be back."

Chalmers finished with 15 points, while Mike Miller stepped up to provide some quality minutes, scoring 12 points on four 3-pointers to help fill the void without Haslem, Pittman and Bosh.

When Miller wasn't in the game, he stretched out along the baseline to cope with his various aches and pains, more comfortable that way than sitting in a chair. When coach Erik Spoelstra called his number, Miller summoned several of his teammates to help lift him up.

"He might be the toughest guy on the team," Wade said.

The Big Two aren't too shabby, either.

Notes: Indiana started 8 of 9 from the field, but went just 26 of 61 (43 percent) the rest of the way. ... The Heat held the Pacers to an average of less than 40 points in the second half over the last three games. ... Miami had only 10 turnovers, its fewest in the series.

Exercise clears the mind. It gets the blood pumping and more oxygen is delivered to the brain. This is familiar territory, but Dartmouth's David Bucci thinks there is much more going on.

"In the last several years there have been data suggesting that neurobiological changes are happening[there are] very brain-specific mechanisms at work here," says Bucci, an associate professor in the Department of Psychological and Brain Sciences.

From his studies, Bucci and his collaborators have revealed important new findings:

  • The effects of exercise are different on memory as well as on the brain, depending on whether the exerciser is an adolescent or an adult.
  • A gene has been identified which seems to mediate the degree to which exercise has a beneficial effect. This has implications for the potential use of exercise as an intervention for mental illness.

Bucci began his pursuit of the link between exercise and memory with attention deficit hyperactivity disorder (ADHD), one of the most common childhood psychological disorders. Bucci is concerned that the treatment of choice seems to be medication.

"The notion of pumping children full of psycho-stimulants at an early age is troublesome," Bucci cautions. "We frankly don't know the long-term effects of administering drugs at an early agedrugs that affect the brainso looking for alternative therapies is clearly important."

Anecdotal evidence from colleagues at the University of Vermont started Bucci down the track of ADHD. Based on observations of ADHD children in Vermont summer camps, athletes or team sports players were found to respond better to behavioral interventions than more sedentary children. While systematic empirical data is lacking, this association of exercise with a reduction of characteristic ADHD behaviors was persuasive enough for Bucci.

Coupled with his interest in learning and memory and their underlying brain functions, Bucci and teams of graduate and undergraduate students embarked upon a project of scientific inquiry, investigating the potential connection between exercise and brain function. They published papers documenting their results, with the most recent now available in the online version of the journal Neuroscience .

Bucci is quick to point out that "the teams of both graduate and undergraduates are responsible for all this work, certainly not just me." Michael Hopkins, a graduate student at the time, is first author on the papers.

Early on, laboratory rats that exhibit ADHD-like behavior demonstrated that exercise was able to reduce the extent of these behaviors. The researchers also found that exercise was more beneficial for female rats than males, similar to how it differentially affects male and female children with ADHD.

Moving forward, they investigated a mechanism through which exercise seems to improve learning and memory. This is "brain derived neurotrophic factor" (BDNF) and it is involved in growth of the developing brain. The degree of BDNF expression in exercising rats correlated positively with improved memory, and exercising as an adolescent had longer lasting effects compared to the same duration of exercise, but done as an adult.

"The implication is that exercising during development, as your brain is growing, is changing the brain in concert with normal developmental changes, resulting in your having more permanent wiring of the brain in support of things like learning and memory," says Bucci. "It seems important to [exercise] early in life."

Bucci's latest paper was a move to take the studies of exercise and memory in rats and apply them to humans. The subjects in this new study were Dartmouth undergraduates and individuals recruited from the Hanover community.

Bucci says that, "the really interesting finding was that, depending on the person's genotype for that trophic factor [BDNF], they either did or did not reap the benefits of exercise on learning and memory. This could mean that you may be able to predict which ADHD child, if we genotype them and look at their DNA, would respond to exercise as a treatment and which ones wouldn't."

Bucci concludes that the notion that exercise is good for health including mental health is not a huge surprise. "The interesting question in terms of mental health and cognitive function is how exercise affects mental function and the brain." This is the question Bucci, his colleagues, and students continue to pursue.

(AP) ? As someone who lived at the edge of the spotlight that shines on the Kennedys, Mary Richardson Kennedy had been there long enough to become a partner in their rituals of grief ? she was there when the clan buried Michael Kennedy, killed in a New Year's Eve skiing accident in 1997, and John F. Kennedy Jr., who died in a plane crash in 1999.

And now, the gathering will be for her, the estranged wife of Robert Kennedy Jr., who hanged herself Wednesday at the family's 10-acre estate in a New York City suburb.

A wake was planned for Friday at the family's mansion in Bedford, according to Ken Sunshine, a publicist working with the Kennedy family. Funeral services were planned for Saturday morning at St. Patrick's Roman Catholic Church in Bedford, with burial to follow in Hyannisport, Mass., where the Kennedy family has a compound.

The Richardson side of the family said in its statement that it was planning a private memorial service in Manhattan.

Her death, at age 52, came as a shock to some friends and family, even though the past two years had been undeniably tough ones. The couple was going through a divorce, and Mary had been charged twice with driving while intoxicated in 2010.

"A lot of times I don't know how she made it through the day," Robert Kennedy Jr. told The New York Times. "She was in a lot of agony for a lot of her life."

But Victoria Michaelis, a friend since Mary's college days, said she hadn't seemed suicidal, or crippled by the alcohol problems that briefly landed her in the headlines two springs ago.

"She was definitely suffering, but she was very, very spiritual and a resolute Catholic," Michaelis said. "I'd say she was depressed the last two years since the divorce. But she would put that aside and ask you how you were. I saw her a couple of weeks ago, and she was fine."

Her death resonated, too, with a public that has watched tragedy march through the ranks of the Kennedy clan again and again.

"I think every family has its tragedies. But this is too much," said Kim O'Connell, who dropped off a bouquet of Calla lilies at the family's home in Bedford on Thursday morning. She had met Robert and Mary only a few times, while working at their health club, but felt a connection anyway. "I just thought she was just a lady. I woke up this morning, and I wanted to do something."

An architectural designer with New Jersey roots, Mary Kennedy met her estranged husband's sister, Kerry, in boarding school when they were still teenagers and had stayed close to the clan through the decades before marrying Robert in 1994.

Robert is the son of Robert F. Kennedy, the former U.S. attorney general who was slain in 1968 while running for the Democratic presidential nomination, and the nephew of assassinated President John F. Kennedy and the late U.S. Sen. Edward Kennedy of Massachusetts.

Mary was RFK Jr.'s second wife, and she entered the family in less-than-storybook circumstances.

When they married, she was already pregnant with their first child, and Kennedy was only weeks removed from the divorce of his first wife.

Yet the wedding had the usual Kennedy touch of romance and politics. The ceremony was held aboard an environmental research vessel on the Hudson River, which Robert had been fighting to protect as an attorney with the environmental group Riverkeeper.

The couple's fourth child ? Robert's sixth overall ? was born while he was serving a 30-day jail sentence for trespassing on U.S. Navy property to protest bombing exercises on the Puerto Rican island Vieques.

"Mary married into the family. But, believe me, the Kennedys don't marry into your family, you marry into their family. So you're transformed when you marry into their family," said Laurence Leamer, author of the book "The Kennedy Women."

"And she was truly a Kennedy," he added. "She was a Kennedy in her interests. Her husband is one of America's leading environmentalists. So was she."

In recent years, police in Bedford had been called several times to the family's home. Twice in 2007, Robert told police that he was afraid his wife would try to hurt herself, according to records obtained by The Journal News for a 2010 report about the series of disturbances.

Police have said almost nothing about the circumstances of the death, but the Westchester County medical examiner's office said after an autopsy Thursday that she died of asphyxiation due to hanging.

A person familiar with the investigation into her death says authorities have concluded that her death was a suicide. The person was not authorized to release the information and spoke on condition of anonymity.

Robert Kennedy Jr. told the Times that no note was found at the scene.

Neither side of her family has discussed her manner of death publicly, but released statements noting her "gentle soul and generous spirit," her work advocating environmentally responsible building designs, and her deep love for her children.

"It's a terrible and tragic time for Mary, her family, and, perhaps most importantly, for Bobby and Mary's children, Conor, Finny, Kyra, and Aidan, and for all of us who loved her," said a brother-in-law, former U.S. Rep. Joseph P. Kennedy II. "We appreciate the expressions of condolence and ask for privacy during this difficult time."

In a statement released late Thursday afternoon, Mary Kennedy's siblings expressed dismay at the way she was being described in some news reports, saying it was "wholly inconsistent with the sister we knew and the life she, in fact, lived."

"She was generous, thoughtful, with a refined aesthetic, genius organizational abilities, boundless energy, physical stamina, and natural elegance," the statement said. "She laughed a lot. Her enthusiasms were deep. She loved to connect people, with no self-interest, and with great intelligence."

Political historian Thomas J. Whalen said he thinks the whole notion of the Kennedys being cursed is largely created by the media, but said that is the perception many Americans have of the family.

"There's no curse. It's just foiled family ambition, risk taking and bad luck," he said. "It's a large family. Things happen in large families, both good and bad."

Mary Kennedy grew up in Hoboken, N.J., the daughter of a professor at the Stevens Institute of Technology. She had two brothers and four sisters.

She was active for years with the Boys & Girls Club in Mount Kisco, volunteering for the club's annual fundraising dinner and hosting its Youth of the Year awards at her home.

With one of her children battling severe allergies, she co-founded the Food Allergy Initiative, billed as the world's largest private source of funding for food allergy research, and appeared with her family at its annual ball at Manhattan's Waldorf Astoria.

Census: Minorities surpass whites in U.S.births

WASHINGTON (AP) ? For the first time, racial and ethnic minorities make up more than half the children born in the U.S., capping decades of heady immigration growth that is now slowing.

New 2011 census estimates highlight sweeping changes in the nation's racial makeup and the prolonged impact of a weak economy, which is now resulting in fewer Hispanics entering the U.S.

"This is an important landmark," said Roderick Harrison, a former chief of racial statistics at the Census Bureau who is now a sociologist at Howard University. "This generation is growing up much more accustomed to diversity than its elders."

The report comes as the Supreme Court prepares to rule on the legality of Arizona's strict immigration law, with many states weighing similar get-tough measures.

"We remain in a dangerous period where those appealing to anti-immigration elements are fueling a divisiveness and hostility that might take decades to overcome," Harrison said.

As a whole, the nation's minority population continues to rise, following a higher-than-expected Hispanic count in the 2010 census. Minorities increased 1.9 percent to 114.1 million, or 36.6 percent of the total U.S. population, lifted by prior waves of immigration that brought in young families and boosted the number of Hispanic women in their prime childbearing years.

But a recent slowdown in the growth of the Hispanic and Asian populations is shifting notions on when the tipping point in U.S. diversity will come ? the time when non-Hispanic whites become a minority. After 2010 census results suggested a crossover as early as 2040, demographers now believe the pivotal moment may be pushed back several years when new projections are released in December.

The annual growth rates for Hispanics and Asians fell sharply last year to just over 2 percent, roughly half the rates in 2000 and the lowest in more than a decade. The black growth rate stayed flat at 1 percent.

The immigrants staying put in the U.S. for now include Narcisa Marcelino, 34, a single mother who lives with her two daughters, ages 10 and 5, in Martinsburg, W.Va. After crossing into the U.S. from Mexico in 2000, she followed her brother to the eastern part of the state just outside the Baltimore-Washington region. The Martinsburg area is known for hiring hundreds of migrants annually to work in fruit orchards. Its Hispanic growth climbed from 14 percent to 18 percent between 2000 and 2005 before shrinking last year to 3.3 percent, still above the national average.

Marcelino says she sells food from her home to make ends meet for her family and continues to hope that one day she will get a hearing with immigration officials to stay legally in the U.S. She aspires to open a restaurant and is learning English at a community college so she can help other Spanish-language speakers.

If she is eventually deported, "it wouldn't be that tragic," Marcelino said. "But because the children have been born here, this is their country. And there are more opportunities for them here."

Of the 30 large metropolitan areas showing the fastest Hispanic growth in the previous decade, all showed slower growth in 2011 than in the peak Hispanic growth years of 2005-2006, when the construction boom attracted new migrants to low-wage work. They include Lakeland, Fla.; Charlotte, N.C.; Atlanta; Provo, Utah; Las Vegas; and Phoenix. All but two ? Fort Myers, Fla., and Dallas-Fort Worth ? also grew more slowly last year than in 2010, hurt by the jobs slump.

Pointing to a longer-term decline in immigration, demographers believe the Hispanic population boom may have peaked.

"The Latino population is very young, which means they will continue to have a lot of births relative to the general population," said Mark Mather, associate vice president of the Population Reference Bureau. "But we're seeing a slowdown that is likely the result of multiple factors: declining Latina birth rates combined with lower immigration levels. If both of these trends continue, they will lead to big changes down the road."

William H. Frey, a demographer at the Brookings Institution who analyzed the census data, noted that government debates over immigration enforcement may now be less pressing, given slowing growth. "The current congressional and Supreme Court interest in reducing immigration ? and the concerns especially about low-skilled and undocumented Hispanic immigration ? represent issues that could well be behind us," he said.

Minorities made up roughly 2.02 million, or 50.4 percent of U.S. births in the 12-month period ending July 2011. That compares with 37 percent in 1990.

In all, 348 of the nation's 3,143 counties, or 1 in 9, have minority populations across all age groups that total more than 50 percent. In a sign of future U.S. race and ethnic change, the number of counties reaching the tipping point increases to more than 690, or nearly 1 in 4, when looking only at the under age 5 population.

The counties in transition include Maricopa (Phoenix), Ariz.; King (Seattle), Wash.; Travis (Austin), Texas; and Palm Beach, Fla., where recent Hispanic births are driving the increased diversity among children. Also high on the list are suburban counties such as Fairfax, Va., just outside the nation's capital, and Westchester, N.Y., near New York City, where more open spaces are a draw for young families who are increasingly minority.

According to the latest data, the percentage growth of Hispanics slowed from 4.2 percent in 2001 to 2.5 percent last year. Their population growth would have been even lower if it weren't for their relatively high fertility rates ? seven births for every death. The median age of U.S. Hispanics is 27.6 years.

Births actually have been declining for both whites and minorities as many women postponed having children during the economic slump. But the drop since 2008 has been larger for whites, who have a median age of 42. The number of white births fell by 11.4 percent, compared with 3.2 percent for minorities, according to Kenneth Johnson, a sociologist at the University of New Hampshire.

Asian population increases also slowed, from 4.5 percent in 2001 to about 2.2 percent. Hispanics and Asians still are the two fastest-growing minority groups, making up about 16.7 percent and 4.8 percent of the U.S. population, respectively.

Blacks, who comprise about 12.3 percent of the population, have increased at a rate of about 1 percent each year. Whites have increased very little in recent years.

Other findings:

?The migration of black Americans back to the South is slowing. New destinations in the South, including Atlanta, Charlotte, N.C., Raleigh, N.C., and Orlando, Fla., saw sharp drop-offs in black population growth as the prolonged housing bust kept African-Americans locked in place in traditional big cities. Metro areas including New York, Chicago, Los Angeles and San Francisco had reduced declines or gains.

?Nine U.S. counties in five states saw their minority populations across all age groups surpass 50 percent last year. They were Sutter and Yolo in California; Quitman in Georgia; Cumberland in New Jersey; Colfax in New Mexico; and Lynn, Mitchell, Schleicher and Swisher in Texas.

?Maverick County, Texas, had the largest share of minorities at 96.8 percent, followed by Webb County, Texas, and Wade Hampton, Alaska, both at 96 percent.

?Four states ? Hawaii, California, New Mexico and Texas ? as well as the District of Columbia have minority populations that exceed 50 percent.

The census estimates used local records of births and deaths, tax records of people moving within the U.S., and census statistics on immigrants. The figures for "white" refer to those whites who are not of Hispanic ethnicity.
